According to TMZ, Kardashian's lawyer Laura Wasser filed the legal documents, which cited "irreconcilable differences." Kardashian reportedly is not seeking spousal support, and asks that the judge reject any request for spousal support from Odom. She is also allegedly asking the judge to legally remove Odom from her last name. In their prenup, the former couple reportedly kept all of their property separate.
The Keeping Up With the Kardashians star, 29, and NBA player, 34, married in September 2009 after one month of dating. The couple has been estranged over the past several months following revelations of Odom's drug use and cheating.
A source close to the reality star shares in the new issue of Us Weekly that Kardashian hasn't spoken to her husband since they spent Thanksgiving apart. "She flip-flopped several times, but she can't imagine having kids with someone who refuses to seek help for his disease," the insider explained.
The spouses have tried to work out their problems. In a preview clip for season nine of Keeping Up With the Kardashian, Odom can be heard on the phone begging for forgiveness. "I would do anything to be accepted back by you guys," he said. "You guys are all I've got."
As hopeful as he was, a pal told Us that Odom knows the relationship is done now and is "really sad." Kardashian, on the other hand, is saying, "'I'm moving on.'"
TMZ first reported on Friday, Dec. 13 of Kardashian's plans to file for divorce. The previous day, Kardashian posted a cryptic message on Instagram: "I am strong because I've been weak. I am fearless because I've been afraid. I am wise because I've been foolish."
Now this story shocks and disappoints me, I wanted and hoped that they would be one Hollywood couple that would make it. And it genuinely seemed like they were very much in love before all this happened. And they seemed so happy before all the shit hit the fan and I just thought that what they had was so special and so beautiful. That I wanted them to work out and stay together for the long haul but I guess it wasn't meant to be after all and that deeply saddens me as a fan of the Kardashian show!
